Prize Draw Terms and Conditions

By taking part in this promotion you accept and agree to these terms and conditions. If you do not agree with any of these terms and conditions then you should not take part in the promotion. It is your responsibility to ensure that you review the terms and conditions before entering the promotion. We, JD Sports Fashion B.V. (“JD Sports”), recommend that you print and store or save a copy of these terms and conditions for future reference during the promotion. JD Sports is the promoter of this promotion.

What can you win?

There will be one (1) winner who will win:

A personal voucher for one (1) tattoo (selected from the promotional video for this prize draw) to use at Dylan Hoogerwerf’s studio (the “Prize“).

JD Sports shall provide the winner with a gift voucher which the winner may use as means of payment for the tattoo as described below.

The Prize will be valid for twelve (12) months following receipt of the voucher. The date and time for the appointment for placement of the tattoo will be mutually agreed between the winner and Dylan Hoogerwerf. The winner can select one (1) design from the designs illustrated in the promotional video for this prize draw. The winner shall enter into a separate agreement with Dylan Hoogerwerf, subject to Dylan Hoogerwerf’s tattooing general terms and conditions: JD Sports shall not itself become a party to the agreement between the winner and Dylan Hoogerwerf.

The Prize is subject to winner confirmation (i.e. JD Sports has been able to contact winners and has been able to confirm eligibility). JD Sports has the right to change, alter or withdraw the promotion or Prize at any time due to any change in any applicable law or any events outside the control of JD Sports. JD Sports shall not be responsible for any delay, cancellation or rescheduling of the Prize. If any part of the Prize is not claimed (for whatever reason), JD Sports is under no obligation to supply an alternative prize.

The Prize is personal to the winner. The Prize is not available for sale, transfer, resale, donation, or exchange (including, without limitation, in person or online via an online auction website or online resale marketplace). JD Sports reserves the right to cancel the promotion and withdraw or make void any and all prize elements if this term is not complied with.

What is excluded from the Prize?

It is the winner’s responsibility to organise and pay for anything excluded from the Prize. Any additional costs and expenses related to the Prize, including but not limited to any follow-up, touch up appointments and after care are not part of the Prize.

Who can enter?

Entrants must be:

aged 18 years or over; and

a resident of the Netherlands.

JD Sports reserves the right to ask the winner to provide proof of age prior to releasing the Prize. Employees (and their immediate family) of the JD Sports group (http://www.jdplc.com/our-group/sports-fashion.aspx), or anyone else professionally connected with this promotion are not eligible to enter the promotion. JD Sports reserves the right (at its sole discretion) to decide if the eligibility criteria are met. If the eligibility criteria are not met, the entry will be invalid.

Liking the post promoting the prize draw (the “Post”); and

Commenting on the Post why you would like to win this Prize.

Internet service providers’ fees may apply when accessing the internet. No purchase is necessary to enter the promotion.

Participation is limited to one entry per person. If more than one such entry is received, only the first entry will be accepted. No responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason.

Closing Times

The promotion will commence on Friday 26 July 2024 at 13pm (NL time) and will end on 29 July 2024 at 23:59pm (NL time). Any entries received after this date and time will not be valid.

How are winners selected?

The winner will be selected at random via comments. The decision of JD Sports is final and binding on all entrants. No correspondence will be entered into regarding the selection of the winners (other than with the winner themself). The winner will be notified via direct message on Instagram. In the event that the winner does not communicate their acceptance of the Prize within 24 hours, JD Sports reserves the right to pick another winner (in accordance with the procedure set out in this section) and the original winner will waive their rights to the Prize.

Winners’ Responsibilities and Disclaimers

It is the winners’ responsibility to: (i) organise and pay costs for anything excluded from the Prize, including travel to and from Dylan Hoogerwerf’s Studio; (ii) complete all stages of the How to enter section above; (iii) provide accurate contact details; (iv) provide valid proof of age which is required to enter the promotion and to redeem the Prize; (v) adhere to local laws in the Netherlands vi) comply with any rules, instructions, requirements, terms and conditions or regulations of JD Sports. JD Sports will not be liable to the winners or any other persons where they fail to comply with such responsibilities and any such failure may result in forfeiture of the Prize.

The granting of this Prize in no way obliges the winner to obtain a tattoo and whether or not the winner wishes to redeem the Prize and obtain a tattoo is entirely at their discretion and is a decision that they should consider seriously before proceeding. If the winner decides to obtain a tattoo under this Prize, JD Sports recommends that the winner undertakes their own research and has a full understanding of the potential consequences of obtaining a tattoo before proceeding.

If the winner decides to proceed and redeem their prize, the winner:

is required to bring valid identification proving their age (over 18 years of age) and identity to their appointment with Dylan Hoogerwerf;

must comply with all requirements and/instructions from Dylan Hoogerwerf, including if requested, signing a contract and/or disclaimer with Dylan Hoogerwerf;

must be in good health and of sound mind at their appointment with Dylan Hoogerwerf;

must not be intoxicated or under the influence of drugs at their appointment with Dylan Hoogerwerf; and

must act in a cordial and respectful manner to Dylan Hoogerwerf

If a winner does not comply with any of these criteria, Dylan Hoogerwerf may, in his discretion, refuse to grant the Prize and the winner may forfeit the Prize and no substitute or alternative will be available.

DISCLAIMER: Tattoos are permanent body adornments that involve a procedure involving needles piercing the skin to place colour and design permanently on the skin. They cannot be removed without a further procedure and this further procedure has no guarantees that the tattoo can be fully removed. The winner understands that placement of a tattoo may be painful and that it may lead to injury, including but not limited to infection, scarring, allergic reactions, difficulties in the detection of melanoma and transmission of blood borne infections. The winner understands that placement of the is permanent and that the intended results cannot be guaranteed with respect to the placement of the tattoo.

IN THE EVENT THAT THE WINNER DECIDES TO REDEEM THE PRIZE AND OBTAIN A TATTOO, JD SPORTS ACCEPTS NO LIABILITY WHATSOEVER IN RESPECT OF THE WINNER’S DECISION TO OBTAIN A TATTOO FROM DYLAN HOOGERWERF. INSOFAR AS PERMITTED BY LAW, JD SPORTS WILL NOT IN ANY CIRCUMSTANCES BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, CLAIMS, PERSONAL INJURY OR DEATH ARISING FROM OR IN CONNECTION WITH THE SUPPLY OR USE OF THE PRIZE. NOTHING IN THESE TERMS AND CONDITIONS SHALL LIMIT ANY LIABILITY WHICH CANNOT LEGALLY BE LIMITED, INCLUDING WITHOUT LIMITATION, LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE OR FRAUD OR FRAUDULENT MISREPRESENTATION. YOUR STATUTORY RIGHTS ARE NOT AFFECTED.

Publicity

By taking part in the promotion, entrants may be invited to participate in publicity at JD Sports’ request if they are a winner of the promotion. Entrants agree that JD Sports (or any third party nominated by JD Sports) may in its sole discretion use their comments relating to the Prize for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid (including for the avoidance of doubt when responding to any third party). Any use of images or other personal information that could identify entrants will be subject to the entrants’ consent.

JD Sports reserves the right to withdraw the Prize (or any part of it) if a winner breaches any of the terms in these terms and conditions or if they are found to have acted in a dishonest or fraudulent manner.
